Seeks to use 'Dark Store' theory to get over $51K refund

Since 2008, when the Wisconsin Supreme Court ruled in Walgreens v. City of Madison that the drugstore chain had been over-assessed for tax purposes and the valuation of its property should be based on comparable stores in the area that are empty, what is known as the "Dark Store" theory, many retail operations have successfully brought lawsuits against municipalities to lower their estimated fair market values and trim their tax bills by tens of thousands of dollars.
