An Eagle River man and woman, each charged in January with one count apiece of possession with intent to deliver more than 50 grams of Fentanyl, have been arraigned in Oneida County Court with judge Mary Sowinski.
ClureIn a preliminary hearing March 27, a not guilty plea was entered for Barry Clure, 69, by attorney Peter T. Vu. Eyewitness testimony of Oneida County Task Force Investigator Luke Linsmeyer was heard, and the defendant was bound over after the court found probable cause exists.
A pre-trial conference was set for May 5, and cash bond for Clure, who remains in custody, was adjusted down to $50,000 from $500,000.
On March 19, co-defendant Susan Cody, 74, waived her preliminary hearing on the charge. A plea of not guilty was entered for her by attorney Thomas E. Hayes Jr.
Her next court date, May 8, is a pre-trial conference. Cody remains in custody, with cash bond set at $500,000.
Clure, Cody and Patrick Menting, 63, were arrested Jan. 17 after a traffic stop in the town of Monico for the expired registration of Clure’s vehicle.
Each of the three faces a fine of up to $100,000 or up to 40 years in prison, or both.
An adjourned initial appearance is scheduled for Menting on April 7. His cash bond was reduced to $25,000 from $500,000 on March 12.
No contact is allowed between the co-defendants.
