Chicago police officer and former officer charged with possessing firearms while intoxicated

Two men with ties to Illinois law enforcement entered not guilty pleas in Oneida County Circuit Court Monday to charges they possessed firearms while intoxicated while visiting Rhinelander.

According to criminal complaint filed April 17, Paul Vincent Bailey, 54, of Chicago, and Patrick Anthony Carr, 57, of Dolton, Ill. were cited following a traffic stop in Rhinelander on Saturday, April 15.

Bailey is an officer with the Chicago Police Department and Carr is a former police officer, according to the complaints.

The two were arrested after an Oneida County deputy stopped a vehicle Bailey was operating during the early morning hours of April 15. The vehicle failed to stop for flashing red lights and crossed the center line, according to the complaints.

Bailey told the officer that his party, which also included two women, was in town celebrating a birthday and had been playing darts at a local establishment. The officer observed signs of intoxication in Bailey as well as Carr, the complaint states.

Carr volunteered that he had a firearm on his person.

Bailey received citations for operating while intoxicated (first offense) and failure to stop for flashing red signal in addition to the single misdemeanor count of possession of a firearm while intoxicated.

In court Monday, he entered a not guilty plea to the misdemeanor charge and the citations.

His attorney, Lindsey Erickson, indicated Bailey would like the confiscated weapon returned to him. While it's not a department-issued weapon, it is used as part of his job with the Chicago Police Department, she said.

Assistant district attorney Jillian Pfeifer objected to the return of the weapon on the grounds that it is contraband.

Judge Mary Burns indicated that issue can be sorted out at a later date.

Erickson also made the same request during Carr's appearance, as she is representing both defendants. Carr entered a not guilty plea to a single count of possession of a firearm while intoxicated.

Both are free after posting $500 cash with conditions that they may not consume intoxicants or be on tavern premises.

They are due back in court in June for adjourned initial appearances.

Possession of a firearm while intoxicated is a Class A misdemeanor punishable by up to nine months in jail and/or a $10,000 fine.
