Arbor Vitae man reaches plea agreement in case involving assault of nursing home patients
Jacob H. Schlosser was originally charged with second-degree sexual assault of a mentally ill person and two counts of second-degree sexual assault in a treatment facility in connection with incidents that allegedly took place in the spring of 2019 while he was a CNA at a Minocqua area long-term care facility. Due to the deaths of both victims, district attorney Michael Schiek had sought to introduce into evidence at trial a text conversation Schlosser allegedly had with a friend where he allegedly discussed what he did with the patients. The state also sought to have audio and video interviews with the two victims admitted into evidence since they are not available to testify.
Schlosser's attorney Elizabeth Svehlek objected to allowing the use of the text messages. Judge Patrick O'Melia sustained the objection, forcing Schiek to file an amended information dropping the third count.
A plea agreement negotiated by Schiek and Svehlek eliminated the need for a two-day jury trial that was scheduled to get underway this week.
Under the terms of the agreement, both Schiek and Svehlek asked that O'Melia order a pre-sentence investigation. At sentencing, Schiek said he would argue for 15 years initial confinement and 15 years of extended supervision. Svehlek is free to argue for a lesser sentence.
Schlosser also faces 15 years of registration as a sex offender once his sentence is complete.
He originally faced up to 40 years in prison on each of the class C felonies.
Sentencing is scheduled for Jan. 5, 2021.
