Stephanie M. Pudlowski, 38, is now charged with having sexual intercourse with a child 16 or older, a misdemeanor, and sexual assault of a student by school staff, a Class H felony.
A charge of sexual assault of a child by a foster parent has been withdrawn.
According to the criminal complaint and testimony of Det. Sgt. Timothy Gensler of the Oneida County Sheriff's Department during the preliminary hearing, Pudlowski's husband provided detectives with video and audio recordings of the alleged victim and the defendant engaging in "inappropriate conduct." Gensler testified the audio recordings allegedly document Pudlowski and the alleged victim engaging in sex acts.
Pudlowski, who was an English Language Arts teacher at James Williams Middle School, tendered her resignation in May immediately after charges were filed.
On July 31, defense attorney Nila Robinson filed a motion to dismiss the "foster parent" charge, arguing that Pudlowski was not a foster parent during the timeframe in question. After the motion was filed, Robinson and Oneida County district attorney Mike Schiek came to an agreement that the "foster parent" charge would be withdrawn and replaced by the new charge. The attorneys advised Judge Michael Bloom of the change during a hearing Thursday. At the same time, Robinson entered not guilty pleas on Pudlowski's behalf.
The alleged victim is not related to Pudlowski but is described in the complaint as a former student. Pudlowski was not the child's teacher at the time of the alleged assault but she was employed by the School District of Rhinelander.
Her next court appearance is set for Dec. 11. If found guilty of the new charge, Pudlowski faces up to six years in prison.
