Oungst jury trial set for October
Evidentiary hearings to be held this summer
By Abigail Bostwick-
Evan Oungst, 28, will also have two days of evidentiary hearings on a number of motions in July before substitute judge Kevin Kline in a related case where he is charged with harboring/aiding a felon and providing prescription drugs during and after the murder. Those hearings are slated before the October jury trial for both that case and the homicide.
According to court records, after a few failed tries, Oungst led authorities to the body of Wayne Valliere Jr., 25, Lac du Flambeau, on New Year's Day 2018. He was arrested along with James Lussier, 20; Joseph Lussier, 27; Richard Allen, 28; and Curtis Wolfe, 28, and charged with first degree intentional homicide (with use of dangerous weapon as party to a crime) and hiding a corpse (as habitual criminal and party to a crime).
Together, they are said to have taken a drug-fueled ride to the remote woods of Mercer where Valliere was beaten and shot by Allen and Joseph Lussier. The body was then left there while the rest returned home, according to court records.
Oungst, who is home on house arrest restrictions, is represented by Thomas Wilmouth and Amy O'Melia and Mike Steinle of Milwaukee. He has pled not guilty to all charges in both cases. Allen and Joseph Lussier were found guilty by jury trial in August. After testifying against his brother and Allen, Lussier pled guilty to lesser charged and was sentenced to 15 years' prison in January. Wolfe, who also testified against Allen and Lussier, is set for trial in May.
Allen wants more time to appeal
In related news, Allen has filed a notice of appeal for post-conviction relief for more time to file pleadings in the Wisconsin Court of Appeals.
Allen is said to have shot Valliere Jr. three times and Lussier fired six shots into Valliere's back following a drive which involved three other men who have also been charged with being a party to the crime of murder and hiding a corpse.
An appeal hearing has yet to be scheduled for Allen.
