Public defenders sought for several defendants in burglary case
By Abigail Bostwick-
Richard Allen, 27, appeared via teleconference Monday afternoon from the Oneida County Jail before Judge Michael Bloom for his second scheduled appearance on felony theft and burglary charges.
"(Allen) is eligible for appointment of counsel from a public defender," noted special prosecutor Richard Dufour via telephone. "Multiple attorneys have been contacted but have been unable to appoint counsel at this time."
In addition to the $10,000 bond in Oneida County, Allen is being held on a $1 million bond in the Iron County Court case involing the murder of Wayne M. Valliere, Jr., 25.
Allen has been charged in connection with that crime along with Joseph Lussier, 26; James Lussier, 19; Curtis Wolfe, 26; and Evan Oungst, 28.
Allen faces two counts of burglary arming self with a dangerous weapon, two counts of theft of a firearm/repeater felon possession of firearm/repeater, all felonies, as party to a crime, in Oneida County.
Also charged with the same in the crimes are Buddy Maurice Big John, 20; Joseph William Cloud, 24; and Dayna Mason, 28.
According to the criminal complaint, a Lake Tomahawk home was robbed of a SCC CPX 9 mm semi-automatic pistol with holster, rounds of CCI .22, rounds of .38 , a 12-gauge shotgun in case, a 10/22 rifle, ammunition box with shells and two kinds of gauge shot shells. Also missing were a PlayStation 4 and several games. The investigation led to the four men.
Dufour told Bloom prosecution would prefer to have one preliminary hearing with Allen, Big John, Cloud and Mason.
"I'd like to drink the water where you live, Mr. Dufour," Bloom observed, referring to the difficulty of scheduling conflicts among the accused and their defense in addition to witnesses. "I think two preliminary (hearings) are more realistic."
Also in court in person Monday was Big John, represented by public defender Mary Burns. His $10,000 cash bond was continued and his preliminary hearing was scheduled for Thursday.
Cloud appeared via videoconference. He is being held in the Oneida County Jail on a $10,000 cash bond in the case in addition to holds on previous bond revocations.
A public defender also has not been found to represent Cloud.
Appearing by videoconference, Mason also does not have a public defender at this time, Bloom noted.
Allen, Cloud and Mason will all be seen Monday, Aug. 27 at 3:30 p.m. for their next adjourned initial appearances.
