Five facing felony charges after alleged beating at party
Richard P. Jorgensen, 20, of Rhinelander, Danny D. Provo, 19, of Tomahawk, and Jordan L. Smazal, 19, of Rhinelander have been charged with aggravated battery, a class E felony, false imprisonment, a class H felony, and duty to aid victim or report crime, a class C misdemeanor, in connection with the incident. Jacob Beachboard, 19, of Tomahawk was charged with aggravated battery and duty to aid victim or report crime. Nicholas E. Boos, 18, of Tomahawk, has been charged with misdemeanor battery and duty to aid victim or report crime.
All had the "party to a crime" enhancer included in their charges.
According to the criminal complaints, a resident of a house in Crescent reported that the 20-year-old alleged victim, who lives in Wausau, was dropped off at his home. The narrative said the alleged victim had "significant bruises and swelling to his face." The individuals at the home were able to give a description of the vehicle operated by the individuals who dropped the man off. The man told deputies that "everyone at the party beat me up." He was able to tell them where the party was held and named Jorgensen and Provo, along with others, as being involved.
The alleged victim was taken to Ministry St. Mary's Hospital for treatment of "multiple fractures to his face."
When the deputies arrived at the location where the man said the party took place, on U.S. Highway 8 in the town of Crescent, the occupant of the house allegedly admitted that a party had taken place at the residence. She said she got into a verbal argument with the alleged victim after he was "disrespectful" to her. She also told police she saw other party attendees kick the man multiple times.
At that point, a vehicle matching the description of the car that dropped off the alleged victim arrived on scene. Upon questioning, Jorgensen admitted to being present while the man was repeatedly kicked. He also admitted to driving the man to Sugar Camp, via the trunk of the car, and then to Crescent before returning to the party.
Smazal allegedly admitted to being one of the people who kicked the man and being with Jorgensen when the man was transported in the trunk of the car.
He also told deputies that after the man was beaten he was dragged to a shed, placed in a lawn chair, fed and then dragged to the car where he was placed in the trunk.
Provo also admitted to being present during the alleged beating and riding in the car during the transport, according to the report.
All five made court appearances this week. Provo and Boos had bond set at $1,500 and $3,500 respectively.
Jorgensen had bond set at $1,500 cash while Smazal and Beachboard had bond set at $1,000 cash. Jorgensen was back in court Thursday before Judge Patrick O'Melia at which time bond was reduced to $1,000 cash and a preliminary hearing was set for June 21.
Provo, Smazal and Beachboard will have preliminary hearings June 19 while Boos will be back in court July 17.
The maximum penalty upon conviction for aggravated battery is a fine of up to $50,000 and imprisonment for up to 15 years while false imprisonment carries a $10,000 maximum fine and no more than six years imprisonment. The misdemeanor charge carries up to 30 days in jail and a $500 fine.
