A 54-year-old Rhinelander man has been sentenced to one year in jail, 15 years probation and lifetime registration as a sex offender after he was convicted of second-degree sexual assault of a child under 16 in Lincoln County Circuit Court June 25.

Steven E. Bailey, who was living in Tomahawk when the crime occurred, was originally charged with two counts of second-degree sexual assault of a child under 16 and one count of second-degree sexual assault causing injury, all class C felonies, on Aug. 3, 2016.

According to the police report attached to the criminal complaint filed the case, Bailey had intercourse with the babysitter of his children, who was 15 years old at the time, on July 30, 2015.

At Bailey's initial appearance on Aug. 3, 2015 before Lincoln County Judge Robert Russell, then Lincoln County District Attorney Donald Dunphy asked for a $50,000 cash bond with the condition that Bailey have no unsupervised contact with any females under the age of 18, with the exception of his own children. Bailey's attorney Joseph Loso successfully argued to have the amount reduced to $25,000.

Bailey waived his right to a preliminary hearing on Oct. 19, 2015, and Russell bound him over for trial.

Bailey's attorney Corey Chirafisi filed a number of motions seeking to have statements made by Bailey and his wife, as well as telephone records, suppressed. On Dec. 12, 2016, Russell ruled that the statements of Bailey's wife were inadmissible but that Bailey's could be used at trial.

Meanwhile, Bailey moved to Rhinelander. The address change was made in the court record on Aug. 17, 2016.

A plea agreement was reached in early 2017 and on June 7 Bailey pled guilty to one count of second-degree sexual assault of a child under 16. The other two counts were dismissed. He was allowed to remain free on bond until the July 25 sentencing hearing.

At that hearing, Russell went along with the sentencing recommendation in the plea agreement, sentencing Bailey to a year in jail, to be served either in Lincoln or Oneida County, starting no later than July 31.

He will be allowed Huber privileges while serving his sentence.

Bailey was also sentenced to probation with electronic monitoring for 15 years and is required to continue with therapy and treatment, and register as a sex offender for the rest of his life.

Bailey faced a maximum of 40 years on each of the three counts.
