Nathan D. Warbalow made his initial court appearance Jan. 3 before reserve judge Mark Mangerson following his arrest Dec. 30.
According to the criminal complaint, the Oneida County sheriff's office received referrals from the Woodruff Police Department and the Oneida County Department of Social Services on Dec. 28 after the Woodruff department was contacted by the father of one of the alleged victims.
According to the complaint, an investigator and social worker interviewed the two alleged victims, ages 8 and 7, on Dec. 29.
The girls told investigators Warbalow encouraged them to pull down his pants and talked them into fondling him through his pants, according to the police report attached to the criminal complaint.
After the arrest, Warbalow was questioned by a sheriff's detective and a social worker. He initially denied the girls' allegations but later admitted that he had the girls touch him at least three times. He also admitted to committing an indecent act while at work at a local gas station in view of the public.
The detective contacted Branch I judge Patrick O'Melia with a probable cause statement and O'Melia set bond at $40,000, with conditions Warbalow not contact the alleged victims or their families and have no contact with anyone under the age of 18, including his own children.
After his initial court appearance on Jan. 3 before Mangerson, the bond amount and conditions were left in place.
His preliminary hearing is set for Jan. 23.
If convicted of the class B felonies, Warbalow faces up to 60 years in prison on each count.
