Appleton man allegedly leads police on drunken chase
Taser used during arrest
According to the deputy's report attached to a criminal complaint charging Keith R. Kelliher with operating while intoxicated 5th or 6th offense and felony bail jumping, the deputy observed a truck driven by Kelliher turn onto State Highway 45 from Margaret Lake Road. When she ran a check on the license she learned there was an active felony warrant for his arrest.
According to the report, when she turned around to stop the truck she could no longer see it and radioed a Three Lakes police officer for assistance.
According to the deputy's report, when neither of them could find the truck on Highway 47, they began checking back roads. The deputy was told by two pedestrians on East Stella Lake Road that they had seen the truck traveling eastbound on Highway 45.
The Three Lakes officer reported seeing the truck turn onto North Big Lake Loop Road. When he activated his emergency lights and siren to stop the vehicle, the truck allegedly sped away at over 70 miles per hour.
Shortly thereafter, Oneida County dispatch received a report from a homeowner in the area that the truck had entered the driveway across from his house. When the deputy arrived at the location, she found the truck with the keys still in it and heard a rustling sound in the nearby wood line. Once the Three Lakes officer arrived, they went into the woods and found Kelliher sitting on the ground talking on his cellphone.
With sidearms drawn, they ordered Kelliher to put down his phone and show both his hands, the report states.
When he would not put down his phone or comply with any instructions, the deputy wrote that she holstered her weapon, pointed her Taser at him and asked him to put down his phone and show his hands. When he would't comply, her report states she used the Taser on him, and he was "then taken into custody without further incident."
Her report also states that Kelliher would not answer questions but did submit to field sobriety tests which the deputy wrote he failed.
A preliminary breath test allegedly showed a reading of 0.109, according to the report.
Kelliher made his initial appearance before Oneida County Circuit Judge Michael Bloom April 3. Assistant district attorney Jillian Pfeifer told the judge that Kelliher had five convictions for OWI in Manitowoc County dating from 1991 to 2006 and had another charge of OWI 5th or 6th filed against him in 2012 in Marinette County that led to the warrant for his arrest.
Bloom set a $10,000 cash bond and scheduled an a preliminary hearing for April 13.
