A 37-year-old Rhinelander man accused of fondling a 12-year-old girl and exposing himself was sentenced to two years probation Wednesday as part of a plea agreement.

Daniel E. Kulwicki Jr. was charged June 18 with first-degree sexual assault (sexual contact with a child under age 13) and exposing his genitals to a child. Both charges are felonies.

According to the police report attached to the criminal complaint, the 12-year-old alleged victim came to the Rhinelander Police Department on April 30 and spoke to a detective. She reported that Kulwicki came into her bedroom and touched her breasts "and that his privates were hanging out of his shorts," according to the report.

The report also said that when she told him to leave her room, he told her that if she told anyone about what had happened he would kill her.

Kulwicki was on probation for a 2014 misdemeanor conviction for having sex with a child 16 or older at the time the April incident occurred. His probation was revoked after the new charges were filed and he was sentenced to seven months in jail with credit for 154 days served.

Kulwicki was scheduled for a jury trial on the new charges Feb. 3, and appeared before Judge Patrick O'Melia with his attorney Daniel Snyder Wednesday for a final pre-trial hearing.

Kulwicki pled no contest to the reduced charges of fourth-degree sexual assault and lewd, lascivious behavior (exposure), both class A misdemeanors.

On the first count, O'Melia sentenced Kulwicki to nine months in jail with credit for nine months served. On the second count, O'Melia withheld sentence and placed Kulwicki on probation for two years. Kulwicki was also ordered to pay court costs and have no contact whatsoever with the victim.

It was stipulated in the plea agreement that if Kulwicki's probation is revoked he will receive no credit for time served.

If he had been convicted of first-degree sexual assault (sexual contact of a child under age 13) Kulwicki faced a maximum sentence of 60 years in prison. Exposing genitals to a child carries a maximum penalty of up to a $10,000 fine and up to three years, six months imprisonment.
