An 18-year-old Harshaw man is facing five felony charges in Oneida County Circuit Court stemming from an alleged incident on Oct. 26 in which he is accused of making sexual advances toward a 10-year-old girl.

Mark L. Moore made his initial appearance Nov. 12 via video from the Oneida County Jail before court commissioner Galen Bayne-Allison. He is charged with attempted first-degree child sexual assault (sexual contact with a child under age 13), causing a child under 13 to view/listen to sexual activity, use of a computer to facilitate a child sex crime, exposing genitals and attempted exposing genitals. The first charge is a class B felony which carries a maximum sentence upon conviction of 30 years in prison. The computer charge is a class C felony with a maximum prison sentence of 40 years in prison and a fine of up to $100,000.

According to the criminal complaint, the Oneida County sheriff's office received a call from the alleged victim's mother on Nov. 5 reporting that the child had received a request for nude photos on Facebook from Moore. The woman told the investigating deputy that Moore set up the account for the child, which the woman accessed from her cellphone.

According to reports attached to the criminal complaint, the incident allegedly happened in a town of Pelican residence. Moore, who is an acquaintance of the family,was in a bedroom with the child watching a movie and chatting on Facebook after he created the account for her. the report says.

The report states that Moore then went into an adjacent bathroom where he made the request for the photos. The alleged victim told her mother she did not send any images to Moore.

The conversation between the two was discovered when Moore contacted the roommate of the alleged victim's mother to ask for the account to be deleted. When the roommate accessed the account, she saw the messages and changed the password so Moore could no longer access the account himself, the report says.

The alleged victim was interviewed by two detectives from the sheriff's office and reportedly confirmed what her mother had told the deputy. She also alleged that when Moore came out of the bathroom after requesting the photos, he exposed himself to her and tried twice to touch her private parts. She told the detectives she pushed him away both times and left the room after the second time. According to the report, she admitted that she did not tell her mother about what had happened, however.

Moore was questioned by the detectives at the jail Nov. 10, after being arrested on a probation violation At first he denied the allegations, but during the course of the interview, the report states he eventually admitted to the events the child had described. When the detectives asked if they could search his phone, he declined to give them permission.

He was then booked on the charges and held until his initial appearance before Bayne-Allison.

Bond was set at $25,000 cash. Moore is also on a hold for violating his probation on a disorderly conduct conviction from Lincoln County last August.

Moore will make an adjourned initial appearance before Branch II Judge Michael Bloom Nov. 30.
