A 17-year-old Arbor Vitae teen is facing a charge of felony retail theft after he allegedly tried to walk out of the Minocqua Walmart with two television sets in a shopping cart.

Sean S. Gibbs was charged with felony retail theft (as a party to a crime) July 30 in Branch II of Oneida County Circuit Court.

According to the police report attached to the criminal complaint, Gibbs and two other individuals entered the Minocqua Walmart just after noon on July 29. Video of the three allegedly shows that one of the other individuals placed two television sets into a shopping cart which Gibbs began to push through the store. Along the way, a socket wrench extension set and a wire wheel for a drill were also placed in the cart.

The report states the video shows Gibbs pushing the cart toward one of the front doors while the other two individuals left through the other. The video also shows two Walmart employees following Gibbs and apprehending him just as he exits the door.

In an interview with a member of the Minocqua Police Department Gibbs said he was stealing the televisions because his brother had just received an XBox and one of the televisions was so he could play the game console on it, the complaints states. He told the officer that he had intended to give the other television to his parents.

He said the tools were for his father, who needed them to work on a car, although Gibbs said his father didn't explicitly tell him to steal the tools.

According to the police report, investigators know the identities of the other two individuals with Gibbs, but as of July 30 they had not been able to contact them.

However, one of the two has been referred to the Oneida County District Attorney's office for a charge of felony retail theft (as a party to a crime) for his role in the attempted theft of the televisions.

When Gibbs appeared before Branch II Judge Michael Bloom, he was released on a $2,000 signature bond and given an Aug. 24 adjourned initial appearance date. A condition of his bond is that he have no contact with the individual also facing charges in the incident.

Felony retail theft as a party to a crime carries a maximum penalty of 3 1/2 years in prison and a maximum fine of $10,000.
