Convicted sex offender facing new charges involving underage girl
According to a criminal complaint filed Oct. 3, Jason L. Mullen had completed about six weeks of a four-year term of extended supervision when he was arrested Oct. 2 and charged with three counts of second-degree sexual assault of a child under 16 with the repeater enhancer. Each charge is a class C felony.
According to the police report attached to the criminal complaint, Mullen allegedly admitted that he had sexual contact with a 15-year-old girl three times in late September.
Police interviewed Mullen after the girl's parents reported the encounters.
According to online court records, Mullen made his initial appearance in Branch I of Oneida County Circuit Court last week. Judge Patrick O'Melia ordered him held on $20,000 cash bond, although his release is unlikely as his extended supervision is in the process of being revoked.
Mullen has a lengthy criminal record in Oneida County. He was convicted of third-degree sexual assault on July 20, 2011 and was sentenced to two years initial confinement and four years extended supervision. On March 18, 2014 he entered a no contest plea to a misdemeanor count of unlawful use of a computerized communication system. He was originally charged with a felony for photographing a minor without consent after his probation agent alerted police that he had several photos of a 13-year old girl on his cellphone. His extended supervision was revoked until his last release on Aug. 12.
Mullen was convicted in 2010 of exposing his genitals to a child, a class A misdemeanor.
If convicted of the new sexual assault charges, he could be sentenced to up to life in prison.
A preliminary hearing in this case is set for Oct. 8 before O'Melia.
