Parties close to plea deal in Thimm case


Michael Thimm, the Rhinelander teen accused of stabbing his mother and her boyfriend last December, is close to finalizing a plea deal with the state.

Oneida County District Attorney Mike Schiek said Tuesday a plea agreement is almost finalized, but there is one issue he and the defense are still discussing - the amount of jail time they'll recommend Thimm serve.

"We have been in discussions," Schiek told the court. "Offers have been made. There have been counterproposals. I think we have an agreement. The joint recommendation on the jail sentence, that's what we're stuck on."

Schiek requested one more court date to resolve the case. Judge Patrick O'Melia set the matter for Oct. 23.

In the meantime, Thimm, 17, will be housed in the Oneida County jail compiling credit toward whatever incarceration period the court ultimately orders. Thimm's attorney, Mary Hogan, said Tuesday her client wants the court to return his posted cash bond so he can go back to jail. Thimm has been free since late December after posting a $15,000 cash bond. He had been in custody for approximately two weeks following the Dec. 12, 2012 stabbing incident.

"He's essentially starting (the jail sentence) sooner rather than later," Schiek said.

Thimm will be allowed release from jail to attend school at the School District of Rhinelander's neutral site and to continue his counseling. Judge O'Melia also didn't object to Thimm being released to continue volunteering at a church soup kitchen in Tomahawk though he noted jail administration would have the final say on that matter.

The pending case against Thimm includes felony charges of attempted first degree intentional homicide and first degree recklessly endangering safety, and a misdemeanor count of disorderly conduct.

According to the criminal complaint and prior court testimony, Thimm went after his mother's boyfriend, Joel Sandberg, with a knife on the morning of Dec. 12, 2012 after the two argued about Thimm staying up late the night before playing role-playing games on the computer. At one point, Sandberg threw Thimm's computer to the floor. Thimm's mother, Theresa Nordquist, was stabbed when she attempted to get in between Thimm and Sandberg. The wounds were non-life-threatening.
