A 36-year-old Rhinelander man is facing the possibility of spending a minimum of three years in prison after prosecutors filed a complaint Friday charging him with one count of possession of child pornography, a class D felony.

Ryan C. Miller made his initial court appearance Monday, with his attorney Gary Cirilli, before Branch II judge Michael Bloom.

According to the complaint, the Oneida County sheriff's office received a report from a Marathon County detective on May 16 alleging that three downloads of child pornography had been detected from a peer-to-peer website. The report also included an ISP address that was traced to Miller.

The detective, who is assigned to the High Tech Crime Unit in Marathon County, sent a computer disc containing the downloaded files, which consisted of videos which appeared to depict child pornography, to Oneida County.

A search warrant was then obtained for Miller's residence and a micro SD memory card was seized.

A forensic analyst with the sheriff's department examined the contents of the memory card and allegedly found 147 videos of child pornography involving children who appeared to be between the ages of 4 and 16 years old. Of the files the analyst found, 72 were identified as duplicates, which left 75 separate and distinct files allegedly showing child pornography, the complaint states.

The analyst's report, which was also attached to the criminal complaint, states six distinct files could be traced to a chat website where anonymous users can engage in and record video chats.

The report also alleges the files were all written to the memory card on June 11, with 49 showing as last being accessed the next day. The report alleges that the files were indicated as deleted but could still be accessed.

At his initial appearance, Miller was allowed to sign a $10,000 signature bond. A preliminary hearing was scheduled for Sept. 13.

In addition to a 25-year maximum prison sentence, with a three-year minimum term of incarceration, the charge carries a maximum fine of $100,000.

In addition, state statutes indicate that upon conviction, the trial court "shall impose a surcharge of $500 for each image or each copy of an image" that is associated with the offense.
