Cassian board discusses liability issues related to bike route signage
While the road is already used for bicycles, and by state law all roads are open to bicycles, adding signage to that stretch of road would increase driver awareness and create a safer condition for both cyclists and motorists, responded Tom Rulseh of OCBWTC.
"I don't think it's necessary," Herman said.
"If you have other questions I'd be glad to answer them," Rulseh said. "I want to make sure you're comfortable with this."
"I'm not," Herman said. "The ATVs, they had to have insurance and everything to go down the road. I feel we're getting into a liability issue, myself. It's already legal for them to ride on the roads the way it is. Me, personally, I don't want to be part of that."
"You, as a supervisor, obviously have a concern about liability, and we appreciate that," Rulseh said. "And that's really why we are here this evening, rather than just waiting for an accident to happen because a road wasn't signed. We think this is a good way to promote safety."
After some discussion, it was decided that chairman Tim Augustine would ask the town's attorney for an opinion on what, if any, liability the town would incur by allowing the signage. The matter will be placed on the September agenda with Augustine expected to report his findings at that time.
Other business:
• An issue with the town hall rental was brought to the board's attention. Treasurer Loretta Morrow read the board a letter she received from the Friends of Birch Lake, which recently rented the town hall for an event. The Cassian Elderly Meal Program contacted the Friends of Birch Lake regarding their possible use of a steamer that is earmarked for the meal program. Because this is a state program, there are special sanitation rules that must be followed regarding use of any of their equipment.
"We have many people who rent our town hall throughout the summer," Morrow said. "Evidently, with the senior meal program, there are some things in this kitchen that cannot be used. Because it is a state program, there are very strict cleaning with them." She was not sure what items were off limits and mentioned this would be a good time to get clear on that. She said she would be meeting with the facilitator of the meal program to find out exactly what pieces of equipment fall under that program. From there, the rental contract for the town hall could be revised and the equipment specific to the meal program could be kept in a locked cabinet where it would not be accessible to those renting the town hall.
• The Board of Review was set for 8 a.m. Sept. 30 and the Open Book at 10 a.m. Sept. 16.
Town clerk Nikki Augustine said she may have swapped the times, but she would verify that and let the board know. Correct dates and times will be posted at a later date.
• Chairman Tim Augustine said it was time, once again, to send out bids for LP gas for the season.
Town clerk Nikki Augustine said she would send out requests for bids to each area propane dealer, requesting the bids be back to the town by Sept. 8. Those sealed bids will be opened at the next town meeting on Sept. 11.
